This page displays the terms and conditions that regulate the process of selling the products shown on our website. www.kayotekstyles.com is a site operated by Kay.Otek; Company License No. 4203970.01 from Sharjah Emirate. We ship to all of the seven Emirates within the UAE.

1. GENERAL

1.1 Scope. Terms & Conditions ( “Agreement” or “Terms” ) is a contract between you and Kay.Otek, as operator of the WebSite. “Company”, “Kay.Otek”, “we”, “us” and “our” refer to Kay.Otek and “you” or “your” refer to the user of the Services. “Services” refers to any services provided at www.kayotekstyles.ae website, which is referred to as the “Site”, or any websites, pages, features, or content owned and operated by us that hyperlink to this Agreement. You are only authorized to use the Services if you agree to abide by all applicable laws to these Terms. 

Refer to our Privacy Policy for information about collection, storing and protection of your information by the Company when you use the Services.

1.2 Terms updates. The Terms and Conditions are subject to change to suit the changes in market conditions and others such as; changes in relevant laws and regulations, changes in technology and payment methods. Existing terms and conditions are applicable at the time you make the purchase. With the exception of changes that are carried out by governmental authorities or the law, in which case, we will notify you before the dispatch of the order. If the consumer fails to communicate disapproval of the changes within 14 days, this will lead to the assumption that the consumer has agreed to the changes.

1.3 Acceptance of Terms. To enter into these Terms, once you place an order, you must be 18 years of age or older and legally eligible to enter binding contracts. The Terms and Conditions that you accept must align with our policies of the country in which the purchase order is placed to be delivered. 2. USE OF OUR SERVICES

2.1 Limitations on Use. By accepting the Terms and Conditions, you are granted limited freedom, which is non-transferable, to use our Services for the purposes of browsing and purchasing our products only. Any form of exploit of our Services and/or brand identity including commercial use, reselling, dissembling and repurposing our products, without a written approval by our company, is prohibited. Publishing information that violates the copyrights, laws and regulations is strictly forbidden. Any violation of the agreement will result in termination of the granted freedom of use. The Company holds the right to cancel orders and/or terminate accounts in reservation of the Terms and Conditions mentioned in this agreement.

2.2 Account Creation and Termination. You will have to create an account ( “User Account” ) to be able to place an order in our Site. You may not use another person’s account and you are solely responsible for protecting the security and confidentiality of the password and identification assigned to or created by you. In the case of an unauthorized use of your account on our Site, you shall immediately notify us.

Periodical restriction to access some or all of our Services on the Site may occur. In case you do not abide by the Terms, we have the right to terminate your user’s access in our sole discretion without prior notice. You are able to terminate your account by emailing us on contact@kayotekstyles.com. Please note that you may lose the assets in your account in the case of account termination. 

2.3 Discounts and Coupons Policy

Discount coupons are generated free of charge following different events available on the Site, however they can also be purchased from our Site, please reach to us on contact@kayotekstyles.com. The coupons that are purchased or generated from a local Kay.Otek Site are to be redeemed only for purchases made on the same local Kay.Otek Site. The discount coupons cannot be applied to sale items. The generated free coupons may have an expiry date or may be cancelled or limited at any time according to the Terms and Conditions. You can apply the discount coupon on the Checkout page in the “Apply Coupon” box.

2.4 Accurate Data. All the data provided by the buyer including names and addresses must be complete, accurate and valid while placing orders. We will not be responsible if the cause of the shipping delay or misplace of delivery is due to incorrect data provided by the buyer. 

3. PROCESSING OF ORDERS

3.1 Payment 

The prices are listed under each product on the website. The prices, discounts, sales are based on our assessment following certain factors at the present time of the product entry. The prices listed on each product exclude the VAT and delivery, which appear on the checkout page. The delivery cost differs from one country to another, and also may be different from cities/states/regions to another. The price of items may be changed for different reasons; however, any change will not affect placed orders. You are able to use one discount code/coupon at a time or merit points per order at the checkout stage. If it is stated on the coupons that they are stackable, you may use these multiple discount coupons per one order.

Payment for all Products must be by credit or debit card. We accept payment with Visa, Visa Debit, Mastercard, Solo, Maestro, Electron and Laser Card. All payments including delivery fees must be paid in advance before we process the order.

3.2 Delivery

Once the payment is received, the order is processed and fulfilled, and you will receive a dispatch email including a tracking number with expected delivery time. In case of any delays from our side, you will be notified via email. 

For any complaints regarding delivery, please allow 30 days after the tracking number has been issued. In order to process any refund related to delivery cost, you need to provide evidence to support your complaint application.

3.3 Import Duty

For international deliveries outside the country of the branch where the order is placed, there might be taxes or import duties added when the package arrives to the destined country. Paying these taxes or import duty are under your responsibility as we have no power over these charges. You may contact your local customs office for information related to these charges before placing any international order. In addition, it is your responsibility to abide by the laws of the country of delivery destination. Kay.Otek will not be accountable for your breach of these laws and regulations. Please note that international shipping is not available at the moment for Kay.Otek stores, however it will be coming soon.

3.4 After Sale

4. INTELLECTUAL PROPERTY

All services provided including the website’s content such as; pictures, scripts, graphics, videos, text and software, etc. and intellectual property related to the products are owned by Kay.Otek. The usage of the content is prohibited, but may be permitted by Us under certain agreements.

5. INDEMNITY

This is an agreement at which you agree to indemnify, defend and release Kay.Otek including anyone who works or involved at the company and related businesses such as; directors, suppliers, employees, agents, consultants from third party claims, liability, damages or costs against Kay.Otek. These arise and not limited to, (1) your breach of terms and conditions for online sale, (2) your breach of Kay.Otek’s intellectual property tights, (3) your breach of conduct for interaction with the other users of services, (4) your breach of any duties related to privacy owned by Kay.Otek, (5) your release of false statements about the products or services of Kay.Otek.

6. WRITTEN COMMUNICATION AND NOTICES

You accept that the communication will be electronically through emails or shared information on the website. You agree that these electronic methods are used for contracts and notices with the compliance with legal obligations of such communications to be in writing. Any notice you provide to us must be directed to contact@kayotekstyles.com. We send notices to you either to your postal address or your e-mail which you provided upon account creation, in addition to any notices provided on the website. These notices are considered received 7 days after a letter is sent to your post code, 48 hours after an email is sent, immediately after the posting on our website. 

7. ENTIRE AGREEMENT, SERVICEABILITY AND WAIVER

The entire agreement between Us and You regarding the Services is constituted by these terms and conditions, replacing any previous agreements. Any invalid provision, does not affect the validity of the other provisions in the Terms and Conditions as long as they are permitted by Law. There are no waivers issued for a certain provision upon Us failing the right of the mentioned provision. In certain situations, waivers may be constituted and it will be stated and communicated to You clearly that it is a waiver.

8. LAWS AND JURISDICTION

Any disputes or claims regarding these Terms and Conditions are governed by the United Arab Emirates law. If You reside in another country and use Our website Services, the use of the website is also governed by the United Arab Emirates Law as long as it does not supersede major laws of Your country of residence. 

Consumers must agree to the jurisdiction of the United Arab Emirates in regards to claims and disputes. There is no limitation to your legal rights to issue disputes or claims against Us, and if you reside in another country than the United Arab Emirates, proceedings can take place in your country of residence.

9. CONTENT CREATORS

If you post pictures or videos using the hashtag #OKayOtek, you agree to grant Us and our related partners, which includes third parties like marketing/advertising agencies, full usage of your royalty-free content posted to any social media platform. We will include your social media user-name, handle, profile, any information you added to the post with the #OKayOtek hashtag, such as; captions, personal information and locations. Your content that we use may be edited by Us while preserving your original idea.

By using the hashtag, you agree that you are the owner of all rights to your user content. In addition, if you use content that includes copy rights of a third party, you have to obtain permissions and consents to publish that content. You also agree that you are above 18 years of age and you are legally permitted to upload content that does not violate any trademarks or copyrights, privacy of any third party or law. You also agree that your content does not violate the terms and conditions of the social media platforms.

We or any other licensed third parties have the right to remove the content any time for any reason.
